THE IMPACT OF DIRECT TO CONSUMER SHIPPING LAWS ON THE SIZE DISTRIBUTION OF WINERIES

The Direct-to-Consumer (DTC) method of wine consumption is an increasingly-popular way for wineries to ship directly to consumers without going through a distributor and retailer. In 2005, the Supreme Court required that if a state allowed a winery to make any DTC shipments to its residents, it must extend that right to all states. Since the Supreme Court decision, an additional nineteen states have passed legislation to allow direct shipments to their state residents, bringing the total as of 2019 to forty-three states. This paper uses data from the County Business Patterns to examine how expanded DTC markets impact the number of establishments and employment for small, medium, and large wineries. It finds that expanded DTC markets result in faster growth in the number of small and medium wineries, and in employment, when compared to large. Moreover, there is little evidence that the effects of DTC on employment and establishment growth differ between wineries in traditional wine producing states and low production states: only California seems to defy this result, where medium wineries see a positive premium, and small wineries experience a negative premium. In all, this paper finds that expanded DTC markets benefit small and medium wineries, relative to large wineries.
