Abstract
Modern China’s urbanization, accompanied by rapid economic development, opening, and reform, is continually progressing. This accelerated development has already resolved nearly all of China’s basic food and clothing needs, but in the process it has been difficult to avoid the emergence of some serious social problems. Since the expansion of cities requires large amounts of land, and there is limited nationally owned urban development land, local governments often turn their gaze towards the expansive suburbs and farmland. This impinges on the interests of the farmers who rely on their land for sustenance. The focal point of this thesis is the protection of farmers’ land rights during the land expropriation process. In China’s present situation, the land expropriation system, as stipulated in law and policy, is still imperfect, and in practice, land expropriation is often not done according to legal procedure. Farmers are a disadvantaged group in the case of land disputes because their land is extremely easy to expropriate. This situation has led to many social problems. In order to understand the protection of farmers’ land rights in the land expropriation process on a deeper level, the author conducted in-depth case studies of five rights protection cases in Shandong Province. The author aims to answer the following questions: First, what differences exist between the rural land expropriation system as established in law and policy and the specific implementation process? Second, to what extent are the current methods of rights protection able to protect the land rights of farmers?
