The Effect of Neuropsychological Impairment and Feigned Adjudicative Incompetence on the Inventory of Legal Knowledge

The Inventory of Legal Knowledge (ILK) is a forced-choice performance validity measure designed to assess feigned adjudicative competence in competence to stand trial (CST) evaluations. Despite the prevalence of neurocognitive injury and illness in forensic populations, the ILK’s sensitivity to neurocognitive impairment has not been systematically examined. We recruited 73 individuals from a hospital-based neuropsychology practice and volunteer service. After administering the Montreal Cognitive Assessment (MoCA) in order to categorize individuals as impaired or non-impaired, we administered the ILK to participants under honest or feigning instructions. Across all groups, feigning participants obtained lower ILK total scores compared to honest participants. Impairment level affected ILK total scores across both instruction sets, with impaired participants obtaining lower ILK total scores than honest participants, although this difference was not significant within honest or feigning conditions. Sensitivity and specificity for the ILK to detect feigned impairment in the present sample was 73% and 93.33%, respectively, which is similar to non-clinical groups from the ILK normative studies. Fourteen individual items were at least moderately correlated to MoCA total score and three of were strongly correlated. Future research should focus on the value of deleting items that are correlated with MoCA performance and determining the influence of actual legal knowledge on ILK performance.
