The Development of Competency to Stand Trial-Related Abilities in a Sample of Juvenile Offenders

The current study examined ratings of juveniles’ knowledge and appreciation of specific Competency to Stand Trial (CST) related abilities and ability to participate in court hearings in order to describe possible age differences in those areas. Using ratings made by forensic examiners on a sample of 263 juvenile defendants referred for evaluation of CST, there was a developmental trend of increasing knowledge and appreciation of CST-related concepts, and ability to participate in court hearings. Eight- and 9-year-old children demonstrated significant deficits in CST-related abilities, while 16- to 17-year-olds demonstrated high percentages of adequate mastery of these concepts. Less clear patterns emerged in 10- to 15-year-olds; however, 10- to 12-year-olds did not consistently differ significantly from 8- to 9-year-olds. Age was significantly positively correlated with CST status, and juveniles found CST were significantly older than juveniles found NCST, in keeping with previous studies. However, more detailed examination of the overall finding leads us to conclude that children 12 and under are likely to have knowledge and reasoning deficits that place them at risk for NCST, whereas children ages 16 to 17 may typically be presumed CST.
